There Is Only One Fast Route Back After Trump

Trump’s administration is routinely ignoring court orders. It’s often refusing to let attorney’s see clients. It’s not respecting Miranda rights. It claims the right to enter homes without warrants and routinely searches without cause. It’s violating habeas corpus every day. ICE and the border patrol (the border patrol is often lumped in with ICE, but many of the worst abuses have been theirs) are brownshirts or Gestapo, whichever analogy you prefer.

The Supreme Court has let most of Trump’s crimes thru, and Trump has massively increased in his wealth in just one year of the Presidency. Trump routinely blackmails Americans, forcing them to do what he wants or he’ll use the power of the Presidency against them

The rule of law is broken in the US. Law is not just about following the letter, though that level is broken, it’s about intent. The fourth amendment is a dead letter in America. Let’s be clear, it’s been in danger for a long time. The exception to the 4th amendment allowing warrentless searches within 100 miles of the border, which pre-dates Trump, was obviously bullshit and meant that two-thirds of the American population is subject to warrantless searches.

The rule of law’s obvious break-down began with pardoning Nixon. When Iran-Contra happened, the people involved had mostly worked for Nixon. They were not indicted. When Bush lied the country into war with Iraq his administration was full of men who had been with Nixon and involved in Iran Contra.

Biden pardoned his own son, an act of sickening nepotism which in a functioning country would lead to him being removed from office before his term end.

On the non-governmental side the crimes of the rich are almost never prosecuted. There was vast fraud leading up to the financial crisis, and no one was indicted for it. After the financial crisis banks systematically used fake signatures on documents containing fake information to foreclose on homes they had not right to. This was not just allowed, but encouraged by government.

The rich and powerful are almost immune to the force of law, but all along the effective rights of ordinary citizens have been under assault. Most people accused of a crime don’t get a trial and they are told that if they insist on one, rather than taking a plea bargain, they will spend much more time in prison. Mandatory sentencing laws have removed most of judge’s discretion and power has moved towards prosecutors. Step by step Mirana rights have been weakened by the Supreme Court. Warrants are often served without knocking, in violent fashion, and we all know that cops lie routinely on the stand and under oath.

Many of the worst abuses started overseas. Detainees were tortured, they couldn’t see lawyers, they have no rights. Thomas Neuburger makes the case that there is now a black site in Minnesota. What starts overseas eventually comes home.

The US is an oligarchy. An oligarchy where there is no rule of law if someone powerful enough wants to break the law.

There is only one road back from this.Mass prosecutions, starting at the top, with Trump and Vance and the cabinet members and family members who engaged in corruption like Jared Kushner and going right down to every ICE brownshirt who violated citizens rights and every prosecutor who went along. Every violation of rights, every major corrupt action.

Of course this means first that the Supreme Court and other parts of the judiciary which aided and abetted by ignoring clear constitutional directives need to be impeached and removed and if possible then themselves tried for crimes. Clearly draconian laws like the one allowing warrantless searches within 100 miles of the border must be repealed.

I don’t pretend that this suggestion is easy or likely. I think the odds of it happening are tiny. But it’s what’s necessary if the Bill of Rights, the Constitution and common law protections for for ordinary people are to mean anything. And it MUST include the powerful. If it’s just a few ex ICE agents getting their knuckles rapped it will mean nothing.

Precedents have been set for over 50 years now that the powerful can get away with doing almost anything awful to ordinary people.

End those precedents with a new one that they can’t, or lose all of your actual rights.

All rights come only from power. If you cannot enforce your rights you have them only if those with more power than you want you to. Every right that you allow someone else to lose, because you aren’t in the group losing rights, you will eventually lose.

More than anything else except stopping American participation in genocide, if I were American this would be my priority. Not even the economy is as is important, because without functioning and fair rule of law nothing else can or will work. If America, internally, is 100% “the strong do as they will, and the weak suffer as they must” everyone in the US who isn’t an oligarch is cooked and even if the rich don’t realize it, so is America as a nation.

    It seems rather obvious to me that modern society is nothing except a catastrophe. The US happens to be the major force powering this tragic mess but others are moving into that position.
    Everything is a con. Money is an artifice and a fraud that has no purpose except empowering a tiny class of bullies to enslave and kill the rest, human and non human alike. The legal system was created to facilitate the power of the ruling class, it has no other reason for existing. Technology can only kill and maim.

    I can’t imagine anything other than an increase in insanity, power and destruction being the future of modern society. The next government will only ever be worse than the current one. The next action of a politician or a judge will only ever be worse than the current one. The next technological “innovation” will only be worse than the current one and so on.
    This seems to be the thrust of humanity at this time.
    People who are aware of this constitute a tiny minority, infinitesimal even. The tools for material resistance don’t exist.
    The people who have the determination and bravery and will to sacrifice are maybe the only real people. They are not judges or politicians or financial sector suit people.

    The only way out is through.
    I don’t know if that makes me an accelerationist.
    And the full force of this brutality hasn’t yet been aimed at me.

    Meanwhile the acceleration in data centre investment, AI and militarisation, can only mean more aggression overseas, accompanied by more suppression and surveillance domestically. Again in the UK, Palantir has contracts with both the defence department and the NHS – what could go wrong?

    Most of the PMC I know seem to be oblivious to (or are simply too self-absorbed to care) about a genocide, let alone see through the propaganda about the ‘axis of evil’ or the creeping authoritarianism.

    Nothing really has changed from colonialism to neo-colonialism. The west enjoyed a brief period post-WW2 of growth and the facade of democracy, mainly driven by reconstruction, oil, and the threat of a good example from communism, but that is now in the rear view mirror.

  7. I agree completely and the only way this is going to happen at this point is not via the electoral process as it is currently comprised and as it currently functions. The Constitution has been exposed for the paper tiger it always was so a new Constitution must be forthcoming, one that doesn’t throw the babies out with the bathwater but instead addresses the myriad of weaknesses that have made the U.S. Constitution a paper tiger.

    The only way I see this can be accomplished at this point with the least amount of death and destruction is a military coup by a strong faction of the military that is relatively benevolent. It’s a gamble for sure but I believe it’s only one of two cards left and it’s the least bloody. The other card is a true violent revolution which would drag the entire world into WWII in my opinion.

    I thought I would never clamor for a military coup, one that suspended democracy for approximately five years as truth & justice was administered as Ian suggests here and also concomitantly during that time convenes a Constitutional Convention the goal of which is to create a new and improved Constitution that amongst other things contains safeguards to prevent this tragic bullshit from ever happening again. A Constitution that spells out in no uncertain terms that it is truly by and for the people, ALL of the people, and not by and for the special interests and the oligarchy.

    My gut tells me something akin to this may very well be in the works — a military coup I mean. It’s taking so long because it is a massive endeavor and a massive gamble. All contingencies must be taken into account and strategies developed to deal with the plethora of contingencies.

    We’ll see. Yes, of course, I won’t hold my breath but my wife can attest, when Trump was reelected for a second term and took office, I said there will be a military coup within a couple of years because it means the Constitution has indeed failed and American governance is truly feckless in the face of this fascist onslaught.

    As part of the truth & justice process during the time of reconciliation, many of the Silicon Valley CEOs and their administrations also need to be prosecuted and locked up for the remainder of their days to include Musk and Theil and Karp and Zuckerberg and Cook and Pichai.

    After making a long response to Edmund J’s misguided claim that “Great” Britain isn’t a fascist-trending shithole yesterday, lamely competing with the Zionists in vicious repressiveness and caste-based racism and repeated terrorist attacks on the “bad” (non-Western) countries, I do want to clarify that nothing I said should be interpreted as supporting the Roman Catholic Church, or organized religion of whatever stripe, generally. I’m anti-authoritarian, my right-wing, deeply authoritarian father taught me well. The Papist cult is a morass of ignorant superstition, misogyny and homophobia, I rejected it entirely when I was 17 and started college, had previously considered it to be disgustingly sex/shame-obsessed, repressive, overly sentimental, and childish. Worship of an omnipotent Sky God Daddy for people who can’t grow up and take responsibility.

    Protestantism at least introduced rationality, instrumentalism and other Enlightenment principles into primitive idolatry. Of course it didn’t take in the long run, cloning a fowl into a fish will result in a non-viable hybrid. Masonry (which developed out of Rosicrucian studies) was a more-enlightened social development that at least allowed for individual freedom of thought and individual conscience (the latter somewhat represented in various Protestant schisms), was over time mostly hijacked by local Elites both in Britain & across Europe and the Colonies, so that the American Deist elites represented by the likes of Ben Franklin, Jefferson, Thomas Paine (certainly the greatest of the revolutionaries and thus rejected and hated by most of his former fellows), etc.

Lawrence’s Studies in Classic American Literature is one of his best books, have shared it over the years with many friends.     1. Trump’s so-called “Board of Peace” appears to be an attempt to bypass — or functionally replace and supplant — the United Nations, an existing multinational organization, by assuming responsibilities the UN is supposed to handle, i.e., overseeing and coordinating post-war reconstruction (of Gaza).

    2. Trump appointed himself as the “Permanent Director” of this Board. He was not appointed by member states, not elected by representatives, and is not constrained by any term limit.

    3. In other words, Trump effectively self-appointed himself as the leader-for-life of a global, multinational organization that he seemingly intends to position as an alternative to — or replacement for — the UN.

    4. Therefore, logically speaking, Trump is now the self-declared God-Emperor of Mankind.

    While I don’t expect to get a peep in reply from Edmund J in the near future if at all (I will at least look back at yesterday’s thread by the end of today), beyond correcting that I obviously am not a defender of Catholic superstition and fear, I would also like to clarify that neither do I endorse racialist essentialism, of the “White Men Can’t Jump”, or Trump’s “I want Jews to handle my money, and as my lawyers,” either.

Despite a marginal amount of German-French blood in my genomic test, here is something that Trump just said at Davos that Edmund should consider:

    Now in fairness, the Scots are, like the Irish and the Galicians in Spain, Celts and not Anglo-Saxons nor WASPs. The entrenched will fight tooth and nail to prevent any reform which affects their interests or touches their slice of the pie. (This is why meaningful healthcare reform is impossible in the US under the existing system.)

    The only solution is revolution or societal breakup, followed by renewal.

    In a longer form. Laws are for little people. Policy is for the wealthiest and powerful; they determine who policy and laws apply to.

    People say, “The government doesn’t care about me.” That is, until a police officer violates your rights. Who determines how the police respond, to no small measure? The people who write the laws, the politicians. Agents of government – because government does nothing without people who are its agents – are very concerned about everyone. Those who write and enforce the laws determine everything from taxes to business (good luck getting that business loan) to employment (don’t have a criminal record for possession of marijuana, etc) to whether or not police wrongfully arrest people.

    We see that in how Wall Street firms are treated differently than from individuals who commit financial fraud. One is more likely to go to jail for writing a fraudulent check than any Wall Street trader or executive committing billions of dollars in fraud.

When we say “all hands on deck” we are clear that chopping off the crew’s hands and tossing them on the deck will not get the job done.     Zionism has become a surprisingly important piece of the negative politics of the United States. But if someone were to wave a wand and every single person in the US for whom Zionism was the major focus of their politics disappeared, the United States would still be a predatory, imperialist oligarchy. Anti-zionism is not antisemitism. But when one pretends that it is the wellspring of US dysfunction, one is using anti-zionism to fill the FUNCTION of anti-semitism: To be the socialism of fools, blaming some small conspiratorial elite for what is in fact a matter of class that functions through the whole of society.

    A politics of pure anti-zionism would be unable to touch the broader problems of the United States or the world. Israel and the backing for its misdeeds is largely a symptom. The real problem is the rich and their greed for ever more, without end, which manifests as class war at home and imperialism abroad, which in both places can lead in the most extreme cases to genocide. Any politics that does not address the wealth and power of the capitalist class and AT THE VERY LEAST cut them down to size, will not do much good.

    Came in after two hours of clearing snow this morning and checked the news. Another killing in Minnesota, details still murky. Other than that it’s the usual mayhem. Trump proposes NATO troops patrolling the Mexican border, which side is unclear like everything else.

    I was ruminating on American history, not the genocide side of it, but federal troops killing miners and suppressing the Wobblies—any labor movement really. Then killing WW1 vets in their DC tent encampments who were seeking pay for their service. Fast forward to Kent State and the NG killing student protesters. I’d say that the US of A has a lengthy tradition of suppressing dissent by murder.

    Was also reflecting on the nostalgia for a glorious American past that never existed. Everybody happy and white with two cats in the yard and all that. The MAGAtts eat that shit up. It’s so, you know, American, baby.

    As for our evolving situation, things are proceeding to shooting. Another one today, a medic. How many deaths does it take to show the people won’t be terrorized in their own communities by the ICE freikorps? How ugly to Trump and his financial backers want to see it get? It is a disturbing proposition, but considering the braveness of the Minnesotans who go out to protest on a day when the high is -20F, we are surely going to find out.

    As for prosecutions, I agree they are not likely because at this point the only way to realistically settle this peacefull is through the Democrats, but they are of course doing the only things they always do: pose, dither, mumble, and perhaps sign a stern letter. Since they are incapable of even pursuing a symbolic act like killing the ICE funding bill, they are not in any way capable of fixing this situation.

    Since there is no solution offered in our official political system, how do you keep one political faction’s federalized goons from running amok like this?
